Welcome to Nasiosi! The terms "we", "us" and "our" refer to Nasiosi. Nasiosi operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Nasiosi is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights as a consumer under European Union and Polish law.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country, state, or province of residence, or that you have given us your consent to allow any of your minor dependents to use the Services under your supervision.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. SECTION 2 - OUR PRODUCTS AND CONFORMITY
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ slightly from how they appear on your screen due to the type of device you use to access the store and your device settings.
For Customers who are Consumers (or Sole Proprietors with consumer rights under Polish law), we guarantee the conformity of goods with the sales contract in accordance with the applicable laws of Poland and the European Union (statutory warranty / niezgodność towaru z umową). Any statutory rights regarding defective products or conformity are fully preserved and are not restricted by these Terms.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer on a case-by-case basis based on legitimate objective reasons.
SECTION 3 - ORDERS AND CONTRACT CONCLUSION
When you place an order, you are making an offer to purchase. The sales contract is formally concluded only when Nasiosi confirms acceptance of your order by sending a separate order confirmation email stating that the order is being processed. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting. If we are unable to accept your order, make a change to it, or cancel it prior to shipment due to unforeseen circumstances (e.g., stock errors), we will notify you immediately using the email or billing details provided.
Your purchases are subject to return or exchange in accordance with our Return Policy [LINK], which fully respects the statutory 14-day right of withdrawal for EU consumers.
SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change. The price charged for a product or service will be the price in effect at the time the order is placed and will be confirmed in your order confirmation email. Unless otherwise expressly stated, posted prices include applicable VAT but do not include shipping, handling, customs, or international import charges if you are buying from outside the European Union.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made at our store. You agree to promptly update your account details, including your email address and payment card expiration dates, so that we can complete your transactions smoothly.
You represent that the payment information you provide is true and correct and that you are authorized to use the designated payment method.
SECTION 5 - SHIPPING AND DELIVERY
All delivery times provided are estimates only and are not strictly guaranteed, although we make every effort to ship products promptly.
⚠️ Important Delivery Risk Transfer Rule: If you are buying as a Consumer (or an individual with consumer rights), the risk of loss or damage to the products passes to you only when you, or a third party designated by you (other than the carrier), take physical possession of the goods. If you are buying as a business entity (B2B transaction), the risk passes to you upon our delivery of the items to the shipping carrier.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design thereof, are owned by Nasiosi, its affiliates, or licensors and are protected by applicable copyright, trademark, and intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any of the material on the Services without our prior written consent.
SECTION 7 - OPTIONAL TOOLS AND THIRD-PARTY LINKS
We may provide access to optional tools or hyperlinks to websites operated by third parties (such as integrated payment operators or social widgets). We do not actively monitor or control these external platforms. Any use of optional tools or external links is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which those tools are provided by the relevant third-party providers.
SECTION 8 - RELATIONSHIP WITH SHOPIFY
Nasiosi is powered by Shopify, which provides the e-commerce platform that enables us to sell our products to you. However, any sales and purchases you make in our Store are made directly with Nasiosi. Shopify is not a party to the sales contract and is not responsible for the fulfillment, quality, or safety of the purchased products.
SECTION 9 - PRIVACY POLICY
All personal information collected through the Services is processed in strict accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy, which can be viewed here [LINK].
SECTION 10 - FEEDBACK AND REVIEWS
If you submit product reviews, suggestions, or comments ("Feedback"), you grant us a royalty-free license to display and use such Feedback for promotional and store management purposes.
You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, or privacy rights. Your Feedback must not contain unlawful, abusive, defamatory, or obscene material, or contain malware that could affect store operations. We reserve the right to remove any feedback that violates these conditions.

Occasionally, information on the Services may contain typographical errors or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors and update information. If an error affects a placed order (such as an obvious pricing error), we will notify you to offer a choice between confirming the order at the correct price or cancelling it.

14.1 This section applies if you deploy any automated software or AI entity ("Agent") to access or interact with our Services. 14.2 No Agent may interact with the Services unless it constantly identifies itself in the HTTP/HTTPS request user agent string as: "Agent/[agent name]". 14.3 We reserve the right to use technical measures to block or restrict any Agents that conceal their automated nature, mimic human behavior pattern variables to bypass security, or overload our platform infrastructure.
SECTION 14 - TERMINATION
We may terminate this agreement or suspend your access to the Services in the event of a material breach of these Terms of Service. Provisions that by their nature should survive termination (including Intellectual Property, Governing Law, and Liability provisions) shall remain in effect.
SECTION 15 - DISCLAIMER AND LIMITATION OF LIABILITY
For Customers who are Consumers, nothing in these Terms shall limit or exclude our liability for non-conformity of goods, damage to health, or any liabilities that cannot be legally limited under applicable consumer protection legislation.
For Customers acting as Businesses (B2B), our liability is limited to the maximum extent permitted by Polish law; we are not liable for lost profits or indirect damages, statutory warranty (rękojmia) is excluded, and our total liability is capped at the amount paid for the specific order.
SECTION 16 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable (such as being declared an unfair contract terms / klauzula abuzywna by a consumer protection authority), such provision shall be deemed severed from these Terms. This determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 17 - GOVERNING LAW AND JURISDICTION
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of Poland.
Any disputes arising out of these Terms shall be settled by the competent courts of Poland. However, if you are a Consumer residing in another EU member state, you also benefit from the protection of the mandatory provisions of the law of your country of residence and have the right to bring a claim before the courts of your home country.

We reserve the right to update or change these Terms due to important changes in legislation or store operations. Registered users will be notified of any material updates via email at least 14 days prior to the changes taking effect.
